Terms of Service

These Terms govern access to Web3 Energy websites, the shared TrueSight demonstration, and any evaluation workspace that links to these Terms. Read them before using the Service.

01 Agreement and eligibility

These Terms form a binding agreement between Web3 Energy Ltd. ("Web3 Energy", "we", "us") and the person or organization using the Service ("you"). By signing in to or using the Service, you confirm that you have reviewed and accept these Terms and acknowledge our Privacy Policy. If you do not accept these Terms, do not sign in to or use the Service.

The Service is intended for people acting in a business or professional capacity. You must be at least 18 years old and legally able to enter this agreement. If you use the Service for an organization, you confirm that you have authority to bind that organization. If mandatory consumer law applies despite this business-only intent, nothing in these Terms removes rights that cannot legally be waived.

02 Service scope

The Service may present charger state, OCPP or related protocol evidence, charging transactions, meter information, anomaly checks, uptime views, charts, reports, and AI-assisted explanations. Features may be incomplete, experimental, simulated, unavailable, or changed without notice.

Public access is for evaluation only. Customer-specific ingestion, persistent investigations, production integrations, service levels, security commitments, support, pricing, data-processing terms, and controlled charger actions require a separate written agreement. If that agreement conflicts with these Terms, the written agreement controls for the covered paid service.

03 Accounts and access

You must provide accurate account information and protect credentials, sign-in links, tokens, and API keys. Do not share access outside your authorized organization. Notify us promptly if you suspect unauthorized access. You are responsible for activity performed through your access unless mandatory law provides otherwise.

Access is personal, limited, revocable, non-exclusive, and non-transferable. It does not grant access to source code, infrastructure, other users' workspaces, administrative systems, or production data.

04 Shared demonstration

The shared demo uses synthetic charging evidence and a common prepared workspace. It may be reset at any time. Prompts and answers are temporary, are not provided as a durable investigation history, and may disappear when the session, process, or demo ends. We do not promise recovery, backup, retention, or export of demo content.

The shared demo is not a confidential environment. Do not enter personal data, customer or driver data, credentials, private keys, payment data, trade secrets, production logs, security findings, or information you do not have the right to use. We may remove demo content or reset the workspace without notice to protect the Service.

Web3 Energy does not intentionally store shared-demo prompts or answers as investigation history. A configured AI provider may process and retain request data for a limited period under its own service and privacy terms. Temporary processing by us or retention by a provider means the public demo must never be treated as a private or confidential channel.

05 AI and analytical output

TrueSight clearly identifies its AI-assisted chat and explanations. When you use those features, you are interacting with an AI system. Other product facts and deterministic checks may be calculated by ordinary software and then presented or explained by AI.

AI and analytical output can be incomplete, delayed, misleading, or wrong. Confidence labels, evidence references, anomaly flags, charts, likely causes, and suggested next steps are aids for qualified staff. They are not guarantees, measurements from a certified instrument, or proof that every relevant event was received.

You must review source evidence and apply independent professional judgment before relying on output. Do not use output as the sole basis for billing, refunds, customer claims, maintenance, safety decisions, regulatory reporting, security response, or charger control. A missing warning does not mean a charger, transaction, site, or integration is safe, compliant, available, or correct.

Output is not legal, regulatory, tax, accounting, cybersecurity, electrical-engineering, or other professional advice. References to AFIR, MID, Eichrecht, OCPP, OCPI, ISO standards, signatures, or audit evidence do not mean that Web3 Energy or the Service has certified compliance.

06 Operational and safety limits

The Service is not designed or certified as an emergency service, electrical protection system, functional-safety system, fire-detection system, certified meter, payment system, accounting system, or continuous control room. It does not replace charger protections, qualified technicians, the operator's CSMS or CPMS, incident procedures, or legally required controls.

The shared demo does not execute charger actions. Any future reset, unlock, stop, configuration, diagnostics, firmware, billing, or similar action requires a separately configured integration, permissions, safeguards, and written commercial terms. An acknowledgement from a charger or external system does not by itself prove that an action succeeded safely.

07 Acceptable use

You must not use the Service to:

  • break any law, regulation, contract, third-party right, or privacy obligation;
  • upload malicious code, unsafe payloads, unlawful data, or instructions intended to manipulate AI output;
  • probe, scan, test, bypass, or interfere with authentication, tenant boundaries, rate limits, security controls, availability, or infrastructure without our prior written authorization;
  • access another person's account, data, charger, integration, or workspace;
  • scrape, bulk extract, resell, sublicense, mirror, or build a competing dataset or service from the Service;
  • reverse engineer or attempt to discover source code, models, prompts, rules, schemas, or non-public interfaces, except to the limited extent the law expressly allows and does not permit contractual restriction;
  • send excessive traffic, automate abusive requests, or use the Service to attack or control an external system; or
  • misrepresent demo output as certified, production-verified, legally compliant, or issued by Web3 Energy for a real customer.

08 Your content and instructions

You keep ownership of information you lawfully submit. You confirm that you have all rights and permissions needed for us and our service providers to process it for the Service. You grant us a limited, worldwide, non-exclusive license to host, transmit, copy, format, analyze, and display that content only as needed to operate, secure, support, and troubleshoot the Service, enforce these Terms, and meet legal obligations.

You are responsible for your content and instructions. We are not required to verify ownership, legality, accuracy, or completeness before processing them. The public demo must not be used for content requiring confidentiality, regulated processing, or a data-processing agreement.

09 Intellectual property and feedback

Web3 Energy and its licensors retain all rights in the Service, software, interfaces, visual design, documentation, charging domain models, taxonomies, checks, workflows, and branding. These Terms give you only the limited right to use the Service for internal evaluation. No other license is granted by implication or otherwise.

If you voluntarily provide ideas or feedback, you allow us to use them without restriction, payment, or obligation to you. This does not give us ownership of your confidential data or independently developed technology.

10 Third-party services

The Service may depend on hosting, identity, mapping, communications, AI, charging, or other third-party services. Their systems, terms, privacy practices, locations, availability, and output are outside our control. Links and integrations do not mean that we endorse or guarantee a third party. Your use of a third-party service may be subject to separate terms.

As described in the Privacy Policy, a prompt and selected context may be sent to a configured AI provider. Do not submit data that the shared demo is not permitted to process.

11 Availability, changes, and suspension

The free Service is provided without an uptime, response-time, support, retention, compatibility, or restoration commitment. We may add, change, limit, suspend, reset, or discontinue any free feature or access at any time. We may impose technical limits and rate limits.

We may suspend or terminate access immediately if we reasonably believe there is misuse, security risk, legal exposure, harm to another user or system, excessive resource use, or a breach of these Terms. We are not responsible for preserving demo data before suspension or termination.

12 Warranty disclaimer

We do not warrant that data is complete, that an anomaly will be detected, that a proposed cause or action is correct, or that the Service meets a legal, regulatory, technical, accounting, metering, cybersecurity, or operational requirement.

13 Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising from or related to the free Service will not exceed EUR 100. For a paid service, the liability rules in the applicable written agreement control. If that agreement contains no liability cap, our aggregate liability will not exceed the fees paid for the affected service during the three months before the event giving rise to the claim.

These exclusions and caps do not apply to liability that cannot legally be excluded or limited, including liability for intentional misconduct, fraud, or death or personal injury caused by negligence where applicable. They also do not remove mandatory data-protection or consumer rights.

14 Business-user indemnity

If you use the Service for a business, you will defend and indemnify Web3 Energy and its personnel against third-party claims, damages, penalties, and reasonable legal costs caused by your unlawful content, unauthorized access, misuse of the Service, violation of another person's rights, or material breach of these Terms. This obligation applies only to the extent permitted by law and only to loss caused by your conduct.

We will give reasonable notice of an indemnified claim, allow you to control its defense with qualified counsel, and provide reasonable cooperation at your cost. You may not settle a claim in a way that admits fault by Web3 Energy, imposes an obligation on us, or fails to release us fully without our prior written consent.

15 Term and termination

These Terms apply while you access or use the Service. You may stop using it at any time. We may terminate free access at any time and may terminate for breach, legal requirements, security risk, or discontinuation of the Service. After termination, your right to use the Service ends immediately.

Sections that by their nature should survive will remain effective, including intellectual property, warranty disclaimers, liability limits, indemnity, governing law, and obligations concerning content already processed. Demo data may be deleted without recovery.

16 Governing law and disputes

These Terms are governed by Bulgarian law, without regard to conflict-of-law rules. For users acting in a business or professional capacity, the courts of Sofia, Bulgaria have exclusive jurisdiction. Before filing a claim, the parties should first attempt in good faith to resolve the dispute by contacting the other party and allowing 30 days for a response.

If you legally qualify as a consumer, this clause does not deprive you of mandatory protection under the law of your habitual residence or mandatory rights concerning court jurisdiction.

17 Changes to these Terms

We may update these Terms to reflect changes to the Service, law, security, or business operations. We will change the effective date and provide reasonable notice of material changes where required. Changes needed for security or legal compliance may take effect immediately. Continued use after the effective date means you accept the revised Terms. If you do not agree, stop using the Service.

18 General terms

These Terms and the Privacy Policy are the complete agreement for the free Service. Failure to enforce a term is not a waiver. If a term is invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining terms continue. You may not assign these Terms without our prior written consent. We may assign them as part of a merger, financing, restructuring, or transfer of the Service.

We are not responsible for delay or failure caused by events beyond our reasonable control, including internet, cloud, power, telecommunications, third-party provider, labor, natural disaster, government, war, or cybersecurity events, except to the extent the impact was caused by our failure to use legally required care. Section headings are for readability only.
